INSTEAD OF THE SHOPPING COMPLEX - PIT

A complex for skateboarders, a beautiful embankment, a venue for celebrations, a fountain, pyramidal flower beds, a bike path and a park where five spotted deer will walk - all this magnificence should have appeared at Belkinsky Ponds almost in 2015.

At that time, the head of the Favor Plus company, Irina FONDERKINA, was drawing the future panorama of the area being developed in the brightest colors. Two billion businessmen will invest in the construction of the complex and one hundred million in the improvement of the territory.

However, dreams were shattered by reality. Now, at the site of the future facility, there is a dug pit and a rickety fence - there are no people, no equipment, no promised deer.

Looking at this desolation, the townspeople think that this phenomenon is temporary - the crisis has hit everyone. But, as it turned out, the point here is not only in financial difficulties, but also in legal ones.

The land where the construction was supposed to unfold, again returned to its former owners - the owners of the parking lot, which functioned here for many years. And how the owner will dispose of the site now is a big question.

Dubious start

The director agreed to reveal all the cards to us law firm"Dauria" Ilya GOLOVKO, representing the interests of Igor BLINOV - the man who sued the builders of "Malina Mall" land.

Igor Vasilyevich is a co-founder of Favor LLC, which originally owned this territory. Four years ago, he moved to Moscow, and at that time his partners sold the land to Favor Plus LLC. It is noteworthy that the director of both organizations was the same person - Alexander VORONIN. As for the amount of the sale, it officially amounted to 2.5 million rubles, - says Golovko.

The price is ridiculous, considering that today Blinov has people ready to purchase land for one hundred and forty million. Nothing so different?

“At the helm” of “Favor Plus” stands Irina Fonderkina and begins to tell fables on the topic: “A shopping center will be laid here.” The stories were so convincing that even the Belkino Estate Foundation added the missing land for landscaping.

As a result: the Obninsk city council applauded, Sberbank agreed to issue a loan for a round sum, work at the construction site finally began to boil. But as it turned out, this was the beginning of the end.

SERIOUS CORPORATE DISPUTES

- When construction began, the contractor made deviations from the project. As a result, they are currently in litigation with the developer, and although Sberbank opened a credit line for more than 1 billion to Favor Plus, it has not transferred a single tranche, the lawyer continues.

In 2015, the director changed again at Favora Plus. Now it is Sergey ZOLOTUKHIN. Apparently, Irina Fonderkina, having probably understood where this ship was going, preferred to get off at the nearest stop.

However, the story did not end there: the former co-owner of the parking lot, Igor Blinov, who learned about the deal of his partners, was able to return the site back by filing a lawsuit against Favor Plus and winning it.

The co-founders of Favor, it seems, were not at all happy with this turn, especially since another lawsuit directly concerned them.

To date, there is a serious corporate dispute between the participants of Favor LLC. The beginning of the conflict was the sale of the site "Favor Plus" for 2.5 million rubles - an amount significantly lower than its cadastral value, - says Ilya Golovko. - The rest of the founders took up arms against Igor Blinov and expel him from the society, starting to increase authorized capital and reducing its share. There is also litigation going on in this regard.

PIT AND FENCE - IS IT FOREVER NOW?

The returned plot is still encumbered by Sberbank, which was imposed due to the fact that a credit line was opened for it. But Igor Blinov has already applied to the court, and as soon as this encumbrance is removed, and this is only a matter of time, the land can be sold again, - Ilya Golovko notes.

At the same time, as Blinov suggests, many well-known entrepreneurs participated in such a large-scale project as Malina Mall, who invested far more than tens of millions of rubles in it and now hope to at least return their money.

These people are in the dark, because they do not know that I have a court decision on the return of this site in my hands. It turns out that they are in the position of deceived equity holders, - Igor Blinov explained to us.

The main question that arises from this whole story is: why do they prefer not to see the official structures that are happening here?

Endless trials can last for more than one more year, and the townspeople will watch the foundation pit “decorating” Belkinsky ponds and the rickety fence all this time?

Why do our authorities in this situation prefer to remain silent and remain neutral?

The Favor Plus company, which was headed by Irina Fanderkina, five years ago, announced its desire to build the "eighth wonder of the world" and outshine all such structures with a magnificent shopping and entertainment palace. Skeptics then were perplexed - literally a kilometer from the future "Malina Mall" is the most popular "Triumph Plaza", and why does the city need a twin brother with a large grocery supermarket, a multiplex cinema, shops, coffee houses and other things? But Fanderkin at a meeting of the city planning council, she beautifully depicted the future: the embankment of the pond in stone, pyramidal flower beds, a fountain, bicycle paths, and, lo and behold! - five spotted deer walking in the park. And it seemed like it would. Sberbank promised billions in loans for construction. He opened a credit line, but did not spend a single tranche. The story is over.

Why this happened is a mystery "behind seven seals." Former director of "Favor Plus" Irina Fanderkina refuses to comment. When she heard that we were interested in the fate of the construction in progress, she said, as she snapped: “Don't call me again!”.

The current director of the company Sergey Zolotukhin said a little more: “Two years ago, I filed a complaint with law enforcement agencies for Fanderkin. The police, the prosecutor's office, the FSB are connected." But he refused to say what is written in the statement: "While the check is being carried out, I will not make statements." Law enforcement officers also do not comment on anything. It is clear that a criminal case has not been initiated, but the check, it seems, has not been completed.

What was happening there among the gentlemen who started the construction of the Malina Mall, only they know, and they don’t really want to let someone in on their secrets. But the result is obvious - there will be not only sika deer. The shopping and entertainment center as such will not be built by Favor Plus. Because he was in bankruptcy.

Trials

At the end of January of this year, Kaluga court of Arbitration decided to introduce a monitoring procedure for Favor Plus. This is the first stage of bankruptcy. This was done at the request of the Moscow company PSK General Contract, to which the construction customers owed a tidy sum. To return at least something, the contractor went to extreme measures.

This is not all. It was planned that Perekrestok supermarket would become the anchor tenant in Malina Mall. We signed an agreement, and Perekrestok made a security deposit of more than 2 million rubles. But Favor Plus did not fulfill its obligations under the contract, did not build anything. The merchants had to sue the developers, and by a court decision, Favor Plus now owes Perekrestok more than 7 million rubles.

What can I say, even went to court Pension Fund Borovsky district and collected from Favor Plus as much as one and a half thousand rubles!

However, the most important issue is about land. What is enclosed by a construction fence is a whole set of plots of different owners. There are leased plots of municipal land - Obninsk and Borovskoye - and private land. There is a fight for her. In addition to Favor Plus, there is also an enterprise with a very similar name, Favor. And the second at first sold his land to the first. And then the court achieved the cancellation of the transaction and the return of the site. But 70 acres returned with a burden - they remained pledged to Sberbank. In order to “clear” the land from collateral, it was necessary to litigate long and hard, and this was achieved.

If some miracle happens and "Favor Plus" somehow gets out of the situation, you can't build the planned shopping mall without a plot of land. And as the representative of the Favor company said Maxim Malukhin, there are plans to build on his site, if he manages to agree, in his words, "with a third force." But what kind of plans and what kind of "power" is, he did not specify.

Position of power

Obninsk municipality does not interfere in the situation in any way. “The main part of the land under the construction site is the territory of the Borovsky district,” commented the vice-mayor for construction Andrey Kozlov. "That's not our area of ​​expertise."
BUT Anton Masnyak, the head of the administration of the Borovsky state farm municipality, on whose territory everything happens, said: “Sooner or later, the courts will end, and some owner of the land will remain there. So he will decide what to do next.” In the meantime, the fenced area sticks out for several years, like an eyesore. And, apparently, some real changes will not begin to occur soon.
