Andrey Gorkov, the top manager of Rosnano, arrested for embezzlement, turned out to be the owner of a three billionth fortune.

Today he was charged under Part 2 of Art. 201 of the Criminal Code of the Russian Federation (abuse of authority). The Basmanny Court of Moscow decided to arrest Gorkov until August 9th. The top manager was detained by employees of the TFR, the GUEBiPK of the Ministry of Internal Affairs of Russia and the SEB FSB after he purchased a ticket for a flight abroad. The defense asked the court to release the accused on bail.

Gorkov does not admit his guilt. “During the interrogation as an accused, Gorkov did not admit his guilt in committing the alleged crime,” the investigator said at the court session. According to him, "Gorkov's guilt is confirmed by the evidence collected in the case, including the results of operational-search activities."
Gorkov's lawyer claims that the bank handed over to the corporation large assets until his license was revoked, so no damage was caused to Rosnano. “Before the license was revoked from the bank, Smolensky Bank transferred assets to Ronano corporation that completely covered the alleged damage, that is, the bank’s obligations, about which there are relevant documents,” the lawyer said.
The investigation establishes the whereabouts of Gorkov's brother Yevgeny. “The case file also contains a report from the district police officer, according to which it is not possible to establish the whereabouts of Yevgeny Vladimirovich Gorkov, since he does not live at the place of registration,” the case file says. Andrei Gorkov stated that his brother had not lived at this address for several years and was not registered.
The defense asked the court to release Gorkov on bail of 50 million rubles. Or put him under house arrest. According to the lawyer, "there is no reasonable and reasonable argumentation in the material about the need to choose such a tough measure of restraint for Gorkov." Gorkov himself said that he did not try to hide from the investigation, but went on a business trip to China. “I was going on a planned business trip to China, for which I had previously received the appropriate visa. I was going to return on June 15,” the defendant said.

Recall that on June 11, the Basmanny Court of Moscow, at the request of the investigation, took into custody for a period of 2 months the top manager of Rosnano, Andrei Gorkov, who was detained the day before, as part of a criminal investigation into financial fraud with the money of the state corporation. The investigation calculated damage to the state corporation in the amount of 738 million rubles, although Rosnano itself noted that they did not have reliable information about this and considered Gorkov's arrest "unfounded."

According to the investigation, in the period from 2011 to 2013, Andrei Gorkov, contrary to the interests of Rosnano, placed the money of the corporation on an ongoing basis in LLC CB Smolensky Bank under the guise of settlement and cash services, in fact financing the activities of the bank. At the end of 2014, the license was revoked from Smolensky Bank, and on the eve of the decision of the Central Bank in favor of Gorkov's brother, Evgeny, assets in the form of real estate objects worth about 400 million rubles were withdrawn from the bank. Law enforcement officers at the place of registration failed to find Yevgeny Gorkov, Andrei Gorkov, who was taken into custody until August 9, denies his guilt.

The Moscow City Court today released Andrey Gorkov, managing director for investment activities of Rosnano, accused by the Investigative Committee of Russia (TFR) of embezzling 198.5 million rubles. The top manager spent a year in jail for abuse of power, the damage from which, according to investigators, amounted to 700 million rubles. At the same time, the corporation did not recognize itself as the injured party, and the prosecutor's office argued that there were no grounds for arresting the businessman.


Having considered the complaint of the defense and the appeal of the Prosecutor General's Office, the Moscow City Court overturned the decision made a month ago by the Basmanny District Court on the arrest of Andrei Gorkov, deciding to immediately release him from custody.

Andrey Gorkov was sent to a pre-trial detention center for committing a crime under Part 4 of Art. 159 of the Criminal Code of the Russian Federation (large-scale fraud). According to investigators, in 2010-2011 he and unidentified leaders of Rosnano concluded agreements with their partners on investing in ESTO-Vacuum LLC, which was supposed to launch the production of automated vacuum installations for ion-plasma deposition and etching of micro- and nanostructures. The total budget of the project was planned in the amount of 1 billion rubles, with this money, by 2016, LLC was to produce 60 installations annually. However, an investment of 198 million rubles. on the part of "Rosnano" did not justify itself. In 2013, the business plan was recognized as a failure, since revenue in the amount of 19 million rubles. didn't fit him at all.

A new case against the top manager of Rosnano was initiated the day before his 12-month limit of detention expired on the first charge of abuse of power (part 2 of article 201 of the Criminal Code). The investigation believed that by placing 700 million rubles belonging to the corporation in Smolensky Bank, which was soon declared bankrupt, Mr. Gorkov caused damage to Rosnano on an especially large scale.

The defense of Mr. Gorkov from the very beginning of the investigation noted that he only acted as an executor of the decisions of the collegial bodies of Rosnano. So, in particular, it was when financing a project with vacuum plants.

The prosecutor's office, which opposed both the detention of Mr. Gorkov and the extension of his arrest, pointed out that both criminal cases against him were being handled by the same investigator, who was supposed to combine both episodes, and not investigate them separately.

In this case, Mr. Gorkov was not subject to re-arrest, as he spent a year in custody.

In addition, the defense of the businessman has already noted that while he was in prison on the first charge, investigative actions were practically not carried out with him. Lawyers believe that the TFR, having no evidence of the guilt of the top manager, counted on the fact that he, being in custody for a long time, would decide to admit his guilt in order to be released. The confession did not follow, and Mr. Gorkov was granted freedom by justice.

Another story with the theft of 200 million rubles from the company continues a year after the arrest of the main defendant. And, as usual, this is again not the head of Rosnano, Anatoly Chubais, who, despite all the scandals, calmly continues to hatch nanotechnological plans for investing the people's money for Russia's future pensioners.

The Basmanny Court of Moscow has re-arrested the managing director for investment activities of Rosnano, Andrey Gorkov, who is accused of embezzling 198.5 million rubles from the corporation. These funds were directed to the production of vacuum plants, but the project turned out to be a failure.

The term of restraint for the previously arrested top manager of the company under the article for abuse (part 2 of article 201 of the Criminal Code of the Russian Federation), which in total resulted in losses of more than 700 million rubles, has expired, but Gorkov was never released. The investigation opened a new case and filed a motion for another arrest. This time under part 4 of article 159 of the Criminal Code of the Russian Federation "Fraud on an especially large scale."

Despite the protests of the prosecutor's office, according to which it should be a new episode, and not a new case, the court decided to satisfy the investigator's petition. Thus, Mr. Gorkov, by the way, who completely denies his guilt, will remain under arrest until August 7.

The official representative of the Investigative Committee (IC), Svetlana Petrenko, said that the managing director for investment activities of Rosnano constantly placed the money of the corporation in a private bank under the guise of settlement and cash services, but in reality financed its work.

The TFR believes that it was Gorkov who convinced the leadership of Rosnano of the need to invest in ESTO-Vacuum, which subsequently collapsed.

The top manager himself claims that he could not influence the company's investment activities in any way, since this was the responsibility of the whole team, and the investment approval scheme itself was multi-stage.

"The first stage is the scientific council, even Anatoly Chubais does not have the right to give instructions to this body, especially not me," Gorkov said.

As Andrey Gorkov's lawyer noted to BFM.ru Sergei Drozda , the new accusation "is not substantiated, absolutely non-specific, from which it is impossible to understand at all what specific actions our client is accused of committing, there is no specifics at all."

Note that the company "Rosnano" for 7 years of its existence has repeatedly been implicated in scandalous stories. Ex-head of the company Leonid Melamed and former member of the board of directors Svyatoslav Ponurov were accused of embezzling 226 million rubles.

According to investigators, in 2008-2009 the funds were transferred to a controlled company that provided consulting services to Rosnano.

Solid scam

Back in 2014, the former first deputy head of the budget committee of the State Duma, and now Deputy of the Legislative Assembly of St. Petersburg Oksana Dmitrieva sent a request to the Prosecutor General's Office with a request to evaluate the financial schemes used by Rosnano. Ms. Dmitrieva referred to the report of the Accounts Chamber of Russia (AC), which contains interesting conclusions based on the results of inspections of the company by the agency.

“All the activities of Rosnano were perfectly investigated by the Accounts Chamber,” she said in an interview with Tsargrad. “There is a whole bunch of economic crimes: and fraud in financial sector, and misuse of budgetary funds, and the transfer of budgetary funds to offshore jurisdictions, and a conflict of interest. Anything!".

In her opinion, all the activities of Mr. Chubais are a complete scam. As for the new accusations against the leaders of Rosnano, they are no longer connected with the previous investigations of the joint venture.

"As far as I can tell, this is something else," Dmitrieva told Tsargrad on air. "The episode about the placement of funds in the amount of almost 740 million does not appear in the department's report, but much more obvious violations appear there."

According to her, in particular, we are talking about the transfer of 14 billion rubles to the Rosnano Capital fund in Luxembourg and Switzerland. Moreover, the transfer was made "to those firms where the founders are persons from the top management of Rosnano, including Mr. Chubais," O. Dmitrieva pointed out.

The deputy also recalled another fact identified by the Accounts Chamber, namely, the distortion financial statements, when the company "Rosnano" from the state corporation was reformatted into OJSC. "We are talking about 50-60 billion rubles," Ms. Dmitrieva stressed.

Profit or Accounting Miracles?

Not so long ago, the state corporation, which halved its losses, made its sole shareholder happy with dividends: the amount of payments for 2017 amounted to more than 500 million rubles. Given the size of government injections into Rosnano, as well as its chronic unprofitability, the amount is not amazing.

From 2007 to 2015, 312 billion rubles were invested in the state corporation. True, it was planned that from 2016 Rosnano would earn money on its own, but, according to the company itself, the crisis and sanctions prevented it from reaching self-sufficiency. In the spring of 2016, the Accounts Chamber, headed by Tatyana Golikova, recognized half of Rusnano's investment projects as ineffective: the expenses of the state company when leaving them brought the company a loss of 13.1 billion rubles.

As told "Tsargrad" director of the Institute of Contemporary Economics Nikita Isaev, over the 10 years of existence of the "wonderful" state-owned company, "Rosnano" has always been unprofitable and only this year is reaching some kind of minimal profit. "Now the interest they pay on accepted loans in the amount of 3.7 billion rubles are not considered losses, but capital investments," N. Isaev concluded. "They are again trying to deceive us by presenting everything in this way."

Chubais under attack?

At the same time, Anatoly Chubais himself not only gets away with it, but also continues to hatch "breakthrough" investment plans.

As Gorkov's lawyer Sergey Drozda told Kommersant, on Wednesday the Moscow City Court considered an appeal of the defense against the decision of the Basmanny District Court, which on June 8 granted the request of the investigator of the Main Investigative Committee of the ICR to arrest the top manager of Rosnano for two months. The judge considered that the new charge of especially large-scale fraud (part 4 of article 159 of the Criminal Code of the Russian Federation) had nothing to do with his previous criminal case on abuse of power that entailed grave consequences (part 2 of article 201 of the Criminal Code of the Russian Federation). Meanwhile, the defense side insisted that the materials on fraud for 200 million rubles. were taken from the old criminal case on causing damage to Rosnano for 700 million rubles. The lawyers tried to convince the court that if the new criminal case was separated from the previous one, then it was illegal to detain Mr. Gorkov. One of the main arguments was the fact that by June 8, the top manager of Rosnano had already spent 12 months on the first charge in a pre-trial detention center, which is the maximum period of detention. They explained the emergence of a new case by their unwillingness to release Andrei Gorkov from custody - the investigators, obviously, hoped to get a confession from him against the top management of Rosnano. Representatives of the prosecutor's office also spoke out against the arrest, saying that the new charge was just one of the episodes of the old investigation.

“Since our arguments were not taken into account by the Basmanny Court, the decision was appealed to the Moscow City Court as illegal and unfounded,” Sergey Drozda said. According to him, the defense in the Moscow City Court was actually supported by the prosecutor, and the representatives of the investigation were not present at the meeting at all. “The hearing lasted an hour and a half, and the rule of law prevailed,” the lawyer said. The Moscow City Court overturned the decision of the Basmanny District Court, after which the lawyers went to the Matrosskaya Tishina pre-trial detention center, where they waited for the release of their client for several hours.

The hitch arose due to the fact that the employees of the Federal Penitentiary Service were supposed to receive certified documents from the appellate instance. At about 6 p.m., the prisoner was finally released.

Lawyer Alexander Asnis, representing the interests of Rosnano, told Kommersant that the company was "satisfied" with the decision of the appellate instance. It should be noted that in both criminal cases against Mr. Gorkov, the investigation recognized Rosnano as the injured party, but the joint-stock company itself does not consider itself as such.

Sources close to the investigation believe that the released Gorkov will soon be summoned to the investigator, who will take from him a written undertaking not to leave the place and proper behavior, which, against the backdrop of the situation that has developed around the case, is the only possible preventive measure.
